Jason: cool! wait until a 6 months goes by and then they start calling you again. Then they tell you "what settlement?" and they have no record that you even paid them. You actually sound like a shill, to be honest.

if there is no lease in place and if there is no agreement between the parties that a late fee will be charged then generally speaking, no late fees may be charged to the tenant.

if and when a new lease is signed the lease would not be able to retroactively seek late fee penalties. the same would be the case even if you are talking about a renewal lease that the LL simply forgot to have you sign. the original lease or renewal lease is read pursuant to the terms of the lease and the dates on the lease.

I am a tenant and there are plenty of lousy landlords. I was asked to leave by my landlord because his daughter is getting divorced and needs the apartment. I complied since they were family friends and my inlaws had lived in the same apartment before for over 20 plus years. In the meantime, the daughter would harass my husband everytime she would see him. I found a place but needed a little more time to clear out of the apartment. I paid rent through August and left September 10th. I still had stuff to clean out was given extra time due to the longlasting friendship. They then changed the locks on the apartment limiting when I could enter and move items. Throughout this process we've tried to be civil since they're elderly but there daughter has caused all types of problems. My husband spoke to my landlord yesterday evening and told her he would be there this a.m. When he arrived the demolition on the apartment had begun, some of my stuff was destroyed and rest was missing. Mind you there was not mention of this last night. Do I have rights?
